Derecho Público2022-02-092022-02-092021-01-25https://hdl.handle.net/10953.1/16056Actualmente, debido a la pandemia producida por el COVID 19, se está produciendo un auge en el uso del teletrabajo como modalidad de trabajo, el cual implica necesariamente el uso de las Tecnologías de la Información y de la Comunicación (TIC). Para el análisis del teletrabajo vamos a aplicar dos normativas genéricas, por un lado, el Real Decreto Ley 28/2020, de 22 de septiembre, de trabajo a distancia, y, por otro lado, en materia preventiva, la ley 31/1995, de 8 de noviembre, de Prevención de Riesgos Laborales. Estudiaremos los derechos y obligaciones que tienen tanto el empresario como el teletrabajador en materia preventiva, los posibles riesgos que pueden derivarse del teletrabajo, así como, el derecho a la desconexión digital, que consiste en garantizar fuera del tiempo de trabajo legal o convencionalmente establecido, el respeto del tiempo de descanso, permisos y vacaciones, así como la intimidad personal y familiar del trabajador.These days, a boom in the usage of teleworking is being produced due to COVID 19’s pandemic, which necessarily has involved the use of Information Technology and Communication (ITC). For the analysis of telecommuting, two generic regulations are being applied. On the one hand, there is the Royal Decree Law 28/2020 of the 22nd of September, of working remotely.
