Abstract

[ES] En el presente trabajo fin de Grado se realiza un estudio detallado del proceso de modificación judicial de la capacidad. El objetivo de este análisis es poner de manifiesto las principales peculiaridades de este proceso. En primer lugar, se distingue entre el concepto de capacidad jurídica y capacidad de obrar, para después mencionar las causas que determinan la incapacitación. En segundo lugar, entramos en el procedimiento, la parte más extensa del trabajo y núcleo del estudio, donde se detallan: los principios, la competencia, las partes, la prueba, la sentencia y las medidas cautelares. Finalmente, se hace una mención al proceso de reintegración de la capacidad[EN] In this work we study the process of judicial modification of the capacity.
