Resumen
[ES] La compatibilidad entre trabajo remunerado y la percepción de una
pensión por incapacidad permanente ha sido debatida desde
diversos puntos de vista a lo largo del tiempo.
Se ha buscado la integración laboral del discapacitado,
centrándose la jurisprudencia en el concepto de profesión habitual
para establecer los límites de la incapacidad.
Los elementos que fundamentan la compatibilidad del trabajo en la
misma empresa o en distinta son los que la delimitan. La reforma
legislativa llevada en la LGSS por la Ley 27/2011 establece dos
perspectivas legales, al igual, la jurisprudencia del TS da un
cambio radical en sus pronunciamientos a partir de la STS de 30
enero 2008. Con la entrada en vigor del TRLGSS se intenta poner
fin a los conflictos interpretativos que generó la anterior LGSS.
El ser pensionista en activo genera una serie de prestaciones por
parte de la Seguridad Social que son analizadas en este trabajo.

It has been sought the professional integration of the disabled, focusing jurisprudence on the concept of current profession to establish the boundaries of disability. The legislative reform on The Social Security Law by the Law 27/2011 establishes two legal perspectives, as the jurisprudence of the TS gives a radical change in their statements from the STS of 30 January 2008. With the entry into force of the TRLGSS is try to end the conflict that generated interpretive previous LGSS.
