GESTACIÓN POR SUSTITUCIÓN: DERECHO COMPARADO Y TRATAMIENTO EN ESPAÑA

Abstract

[ES] En este Trabajo de Fin de Grado se analiza la figura de la gestación por sustitución en el ordenamiento jurídico española! objeto de analizar la situación existente, el presente, para así entender y exponer su proyección, el futuro. Para ello se ha realizado un examen de las diferentes formas por las que se puede determinar la filiación actualmente en España y los cambios que han sufrido estas figuras a lo largo de los años. En segundo lugar, se aporta el concepto que distintos autores dan a la figura de la gestación por sustitución y, se realiza un estudio de ésta en el derecho comparado. En tercer lugar, se analizan las resoluciones más importantes habidas en nuestro país con respecto al tema y, finalmente, se aporta una propuesta de regulación de la figura y algunas reflexiones.[EN] In this Final Project Grade the figure of the gestation by substitution is analyzed in the Spanish legal system to understand this situation in the present and explain it in the future. In order to do that, this work has made a review of the different ways in which you can determine the parentage currently in Spain and the changes that have suffered these figures over the years. Secondly, it is provided the concept that different celebrities give to thefigure of gestation by substitution and its comparative law has been studied. In the next point, the most important resolutions in our country are analyzed and finally it is provided a proposed regulation and sorne conclusions
