Resumen
El objeto de estudio del presente Trabajo Fin de grado consiste en
un análisis jurídico sobre la regulación de la interrupción
voluntaria del embarazo en España, exponiendo
cronológicamente las permisiones que han surgido en el tiempo
hasta los supuesto permitidos en la actualidad. Por tanto, se
examina la posición mantenida por la doctrina del Tribunal
Constitucional acerca del conflicto entre el derecho fundamental a
la vida y la interrupción voluntaria del embarazo. Asimismo, se
realiza un enfoque global de otros países. La interrupción
voluntaria del embarazo es un tema controvertido en toda la
sociedad, tanto por los posibles conflictos entre la vida del
nasciturus y la libre decisión de la mujer sobre su maternidad,
como por las diferentes perspectivas al respecto. Así pues, es
importante conocer las circunstancias que han llevado a
considerar la interrupción voluntaria del embarazo como delito
penalmente castigado a consagrarla como un derecho.
The aim of the present study of the Final Degree Project consists of a legal analysis of the regulation of the voluntary interruption of pregnancy in Spain, exposing chronologically the permissions that have arisen over time up to the assumptions allowed at presents. Therefore, the position held by the Constitutional Court´s doctrine on the conflict between the fundamental right to life and the voluntary interruption of pregnancy is examined. Likewise, this study carries out a global approach to other countries. The voluntary interruption of pregnancy is a controversial issue in every society, not only because of the posible conflicts between the life of the unborn child and the free choice of the woman about her motherhood, but because of the different perspectives in this regard. Thus, it is important to know the circumstances that have led to consider the voluntary interruption of pregnancy as a punishable crime to constitute it as a right.
