LIBERTAD DE EXPRESIÓN: EVOLUCIÓN, LIBERTAD DE INFORMACIÓN, DISCURSO DE ODIO Y LÍMITES.

Abstract

[ES] La libertad de expresión es un Derecho Fundamental verdaderamente amplio, que ha ido evolucionando y adaptándose a los nuevos tiempos y a la necesidad de relacionarse con otros ámbitos constitucionales y del Derecho como la libertad de información y el discurso de odio. Observaremos las diferencias interpretativas entre los Tribunales españoles y la Unión Europea, comentaremos los límites y para poder darle una visión más actual, además de comentar varias sentencias del Tribunal Europeo de Derechos Humanos, veremos la problemática actual que existe con las redes sociales y también varios casos que han ocurrido recientemente en España y que han sido muy comentados tanto en redes sociales como en la prensa y han supuesto un desafío jurídico para los juzgados y tribunales españoles en relación con la libertad de expresión, que es el derecho sobre el que gira todo el trabajo.

[EN] Freedom of expression is a truly broad Fundamental Right, which has been evolving and adapting to the new times and the need to relate to other constitutional and legal spheres such as freedom of information and hate speech. We will observe the interpretative differences between the Spanish Courts and the European Union, we will comment the limits and to be able to give a more current vision, besides commenting on several judgments of the European Court of Human Rights, we will see the current problems that exist with social networks and also several cases that have recently occurred in Spain and that have been much discussed both in social networks and in the press and have been a legal challenge for Spanish courts and tribunals in relation to freedom of expression, which is the right on which everything revolves the project.
