Resumen
[ES]El ámbito del transporte aéreo conforma una categoría de contratación, donde el consumidor puede resultar perjudicado debido a acciones por parte de las compañías de transporte aéreo. En particular, en cuanto que al tratarse de contratos en los que las entidades de transporte pueden fijar, y de hecho es lo habitual que hagan, las condiciones generales que conforman el contenido de la relación contractual, suelen incluir cláusulas que no siempre son acordes a Derecho. Más aún, si tenemos en cuenta que en el contrato de pasaje la compañía aérea concluye esta relación con un consumidor o usuario. En este supuesto, las condiciones que implican un desequilibrio relevante para la parte más débil del contrato pueden calificarse de abusivas en virtud del contenido de la legislación que protege a los consumidores y usuarios en relación con los contrato tipo (o con condiciones generales).
La tutela de los intereses de los consumidores y usuarios, como es sabido, es un principio constitucionalmente reconocido (art. 51 de la CE) y que ha sido desarrollado mediante la aprobación de una normativa específica que, junto a las disposiciones aplicables al contrato de transporte aéreo con los pasajeros, es indispensable observar a efectos de que el contrato sea lícito.
[EN]The scope of air transport forms a category of contracting, where the consumer can be harmed due to actions by the airlines. In particular, inasmuch as, inasmuch as, in the case of contracts in which the transport entities are able to fix, and in fact they do, the general conditions which form the content of the contractual relationship, they usually include clauses which are not always in accordance with Law. Moreover, if we take into account that in the contract of passage the airline concludes this relationship with a consumer or user. In this case, the conditions which imply a significant imbalance for the weaker party to the contract may be characterized as abusive by virtue of the content of the legislation protecting consumers and users in relation to standard (or general) contract. The protection of the interests of consumers and users, as is well known, is a constitutionally recognized principle (Article 51 of the EC) and has been developed through the adoption of specific legislation which, together with the provisions applicable to the contract of Air transport with passengers, it is indispensable to observe for the purpose that the contract is lawful.
