Resumen
[ES] El objeto principal de este trabajo es analizar el proceso de incapacitación, cuya regulación, pese a las anteriores modificaciones de la Ley de Enjuiciamiento Civil, se distinguía por la falta de claridad respecto a los distintos aspectos del procedimiento, obligando a los jueces y tribunales a resolver sobre tales lagunas legales. También era inevitable a su vez, acudir a preceptos legales que no se ajustaban del todo a las necesidades del procedimiento de incapacitación. Sin embargo, con la entrada en vigor de la nueva Ley de Enjuiciamiento Civil 1/2000 se pretende instar soluciones a todas aquellas carencias existentes, regulándose legalmente como un procedimiento especial.
[EN] The main purpose of this project is to analyze the incapacitation process, whose regulation, despite the previous modifications of the Civil Procedure Law, was distinguished by the lack of clarity regarding the different aspects of the procedure, forcing the judges and courts to settle on such loopholes. It was also unavoidable, in turn, to resort to legal precepts that did not fully conform to the needs of the incapacitation procedure. However, with the entry into force of the new Civil Procedure Law 1/2000, it is intended to urge solutions to all existing deficiencies, legally regulated as a special procedure.
