Resumen
[ES] La tutela cautelar es manifestación, o si se prefiere, una
modalidad de tutela judicial efectiva, instrumental a ésta. De este
modo el Tribunal Constitucional se ha ocupado de señalar que “la
tutela judicial no es tal sin medidas cautelares adecuadas que
aseguren el efectivo cumplimiento de la resolución definitiva que
recaiga en el proceso”.
En el proceso civil, las medidas cautelares devienen por la
instauración en la Constitución Española del derecho a la tutela
judicial efectiva, plasmado en el Artículo 24 de la misma, con el
objeto de anticipar los efectos de una futura e hipotética sentencia
definitiva, con el fin de evitar que un posible fallo favorable a la
pretensión deducida quede desprovisto de eficacia. Por ello, el
objeto de este trabajo es conocer esta institución procesal, así
como la regulación de la misma.
[EN] The precautionary protection is a manifestation, or if you prefer, a form of effective judicial protection, instrumental to it. In this way, the Constitutional Court has taken care to point out that "judicial protection is not with the appropriate precautionary measures to ensure the effective compliance of the final decision that falls within the process." In the civil process, the precautionary measures become the establishment in the Spanish Constitution of the right to effective judicial protection, embodied in Article 24 of the same, in order to anticipate the effects of a future and hypothetical final judgment, with the In order to avoid that a possible failure favorable to the claim deduced is devoid of effectiveness. Therefore, the purpose of this work is to know this procedural institution, as well as the regulation thereof.
