MENORES: PAPEL Y PROTECCIÓN JURÍDICA EN LAS CRISIS MATRIMONIALES

Abstract

[ES] En España, en la última década, hemos tenido una profunda reforma en cuanto a los menores, por eso creíamos necesario hacer un breve apunte respecto a la evolución de éstos, hasta llegar a la actual legislación. Para así poder analizar cómo en el tráfico jurídico -demandas, modificaciones de demandas…- se lleva a la práctica esas modificaciones. Para ello ha sido necesario estudiar las anteriores leyes de menores y las actuales, no sólo en España sino en el marco internacional, observando como el derecho de familia – crisis matrimoniales- afecta a los menores en temas de custodias compartidas, y cómo han evolucionado los criterios jurisprudenciales al respecto.

[EN] In Spain, in the last decade, we have had a profound reform in terms of minors, so we thought it necessary to make a brief note regarding the evolution of these, up to the current legislation.
