DESHEREDACIÓN POR MALTRATO PSICOLÓGICO AL TESTADOR

Abstract

[ES] Este trabajo tiene por objeto el maltrato psicológico como causa de desheredación a los descendientes. A raíz de las necesidades surgidas en el contexto social actual, la jurisprudencia ha modificado la línea tradicional de interpretación de las causas de desheredación, haciendo del Artículo 853.2 del Código Civil una interpretación más flexible y en relación con el Artículo 3 del Código Civil, que permite atender al espíritu y finalidad real de las normas. Dos sentencias han sido las que han hecho cambiar esta línea jurisprudencial, la Sentencia del Tribunal Supremo de 3 de junio de 2014 y la Sentencia del Tribunal Supremo de 30 de enero de 2015, permitiendo así una adaptación que las leyes aún no ofrecen.

[EN] This project focuses on psychological abuse as a cause of disinheritance to the heirs. Due to the growing needs in the current social context, jurisprudence has modified the traditional interpretation of the causes of disinheritance, turning Article 853.2 of the Civil Code into a softer interpretation under Article 3 of the Civil Code, which refers to the spirit and real purpose of the laws. Two Supreme Court rulings have changed the previous jurisprudence, the Supreme Court's Judgment of June 3, 2014 and the Supreme Court's Judgment of January 30, 2015, allowing an adaptation that the laws do not yet offer.
