LA DISOLUCIÓN DEL MATRIMONIO: EL DIVORCIO

Abstract

[ES] El presente trabajo trata de analizar la figura del divorcio como causa de disolución del matrimonio en el Ordenamiento Jurídico Español. Se aborda el concepto y la introducción al matrimonio para comprender y situar al lector, adecuadamente, en la parte principal de este estudio, los efectos derivados del divorcio. Trata así, todas las medidas que la normativa preceptúa y que deberán regir las futuras relaciones entre los progenitores. La compleja casuística que estas consecuencias originan en la práctica, han propiciado tratar la materia, principalmente, desde la visión de la Jurisprudencia, a fin de poder observar la realidad de esta figura en nuestros tiempos.

[EN]This essay is about the way the Spanish Law deals with the divorce as a way to dissolve the marriage. We will strat reviewing the marriage to introduce the reader into the main topic of this piece, the legal consequences of the divorce. We focus on the provisions of the Law that should guide the future relations between the divorced parents. In practical terms, the wide range of situations and the complex nature of this issue favor its consideration from a Jurisprudence point of view, with the goal of understanding this reality in our times.
