LA MEJORA, LEGÍTIMA FRENTE A TERCEROS, LIBRE DISPOSICIÓN PARA EL TESTADOR

Abstract

[ES] En este trabajo estudiaremos la institución de la mejora, que se trata de una institución de derecho sucesorio con una gran tradición jurídica en nuestro país, la cual ha generado importantes debates jurídicos a lo largo de todos los siglos de su historia entre la doctrina y la jurisprudencia, los cuales algunos siguen abiertos aun hoy día. A través de las diferentes corrientes doctrinales intentaremos esclarecer las cuestiones más problemáticas entre las que destacan la naturaleza jurídica de dicha figura, la posibilidad de delegar la facultad de mejorar, la admisión o no de las mejoras tácitas en nuestro ordenamiento o el papel que juega el derecho de representación entre otros.

[EN] In this paper we study the institution of la mejora, which is an institution of inheritance law with a legal tradition in our country, which has generated important legal debates over the centuries of its history between doctrine and jurisprudence, which some remain open even today. Through the different doctrinal currents try to clarify the most problematic for example the legal nature of that figure issues, the possibility of delegating the power to improve, admission or not tacit improvements in our legal system or the role of the right of representation among others
