RÉGIMEN JURÍDICO DE LA RESERVA LINEAL

Abstract

[ES] Este trabajo se ha llevado a cabo con la finalidad de elaborar un estudio que nos permita analizar todo el precepto contenido en el artículo 811 del Código Civil relativo a la reserva lineal, siendo esta una de las figuras más clásicas y desconocidas de nuestro Derecho Sucesorio Español. El trabajo está estructurado en dos partes, en la primera de ellas se ha realizado una breve introducción a esta institución, destacando sus precedentes históricos, su finalidad, así como su fundamento y estructura de la misma. En la segunda parte se ha analizado el elemento subjetivo de esta reserva, indagando tanto en los derechos como en las obligaciones de las personas involucradas en el momento del fallecimiento del causante de la reserva

[EN] This study has been carried out with the purpose of elaborating a study which allow us to analyze the precept content in the 811th of the Civil Code relating to booking, being this one of the most classic and unknown of our Spanish Inheritance law. This work is made of two parts, one of them is a brief introduction to this institution, highlighthing his historical precedents, the purpose as well as his foundation and structure. In the second part it has been analyzed the subjective element of this reserve, inquiring into the rights and duties of the people involved in the exact moment of this reserve’s death
