DERECHOS SUCESORIOS DEL CÓNYUGE VIUDO

Abstract

[ES]El cónyuge viudo según el Código Civil es considerado como un heredero legitimario. El derecho hereditario del cónyuge viudo se otorga en concepto de usufructo, teniendo el cónyuge, por tanto, derecho al uso y disfrute de lo que le corresponda por legítima. Para conservar sus derechos sucesorios el cónyuge no puede estar separado ni divorciado del causante. En los casos en los que haya mediado reconciliación entre los cónyuges, conservará el cónyuge viudo sus derechos sucesorios. El usufructo del cónyuge viudo tiene la particularidad de que puede ser conmutado por diferentes medios y formas.
