Derecho de transmisión

Abstract

[ES]El derecho de transmisión tiene por objeto, el derecho de aceptar o repudiar la herencia del primer causante (ius delationis.) Derecho en cuya virtud el heredero fallecido entre la delación y la adquisición hereditaria, transmite a los suyos el mismo derecho que él tenia en la herencia del primer causante, con las mismas facultades. Regulado en el Art. 1006 CC, en cuya virtud “Por muerte del heredero sin aceptar ni repudiar la herencia pasará a los suyos el mismo derecho que él tenia”.

[EN]The purpose of the right of transmission is the right to accept or repudiate the inheritance of the first offender (ius delationis.) Right under which virtue the deceased heir between the delación and the hereditary acquisition, transmits to his own the same right that he had in the inheritance of the first cause, with the same faculties. Regulated in the Art. 1006 CC “ By the death of the heir without accepting or repudiating the inheritance will pass to his own the right that he had.
