LA PREJUDICIALIDAD CIVIL Y PENAL EN EL PROCESO CIVIL

Abstract

[ES]Se estudiará la prejudicialidad penal y civil en el marco del proceso civil, en relación a la estructuración de los conceptos jurídicos que configuran la institución. Para ello se analizará la regulación y problemáticas de la Ley 1/2000, de 7 de enero, de Enjuiciamiento Civil, diferenciando la cuestión prejudicial de otras figuras afines, y distinguiendo los diferentes presupuestos y efectos de la suspensión del proceso, tanto en la cuestión prejudicial penal como la civil. Igualmente se realiza una comparación con el ordenamiento jurídico del estado italiano.

[EN]Will be studied the criminal and civil prejudicial question, in relation to the structuring of the legal concepts that conforms the institution. For this purpose, will be analyzed the regulation and problems of the Spanish Code of Civil Procedure, differentiating the question from other similar figures, and distinguishing the different specifications and effects of the suspension of the process, both in the question criminal as the civil. A comparison is also made with the legal system of Italy.
