La pensión de alimentos en hijos mayores de edad

Abstract

[ES]La pensión de alimentos a hijos mayores de edad tiene su fundamento legal en el artículo 93.2 del Código civil, y se podrá establecer dicha pensión para los hijos mayores de edad en los procesos matrimoniales, y comprenden, según el artículo 142 del Código civil, todo lo que es indispensable para el sustento, habitación, vestido y asistencia médica, y también la educación e instrucción del alimentista cuando no haya terminado su formación por causa que no le sea imputable. Esta pensión a los hijos mayores de edad se dará siempre que el hijo mayor carezca de ingresos propios suficientes para vivir y que conviva en el domicilio familiar. Si no se dan estos requisitos, la pensión no se impondrá. Hay diversas causas de extinción de la pensión, una de ellas es la falta de dedicación del hijo a los estudios, y la posibilidad de acceder a un puesto de trabajo.
