EL ACUERDO DE MEDIACIÓN: LA FORMALIZACIÓN DEL TITULO EJECUTIVO.

Abstract

[ES]La mediación es un procedimiento de solución de conflictos, alternativo a la vía judicial, en el que las partes intervienen voluntariamente con el fin de llegar a un acuerdo acudiendo a un mediador neutral e imparcial que, a través de una escucha activa, tratará de extraer lo mejor de cada parte en la búsqueda de la mejor solución posible al conflicto planteado. Pudiendo alcanzar el acuerdo fuerza ejecutiva para asegurar su cumplimiento, mediante la oportuna elevación a escritura pública, si la mediación se lleva a cabo al margen de un proceso judicial, o bien, mediante homologación judicial (auto) en caso de un procedimiento judicial abierto al efecto.

[EN]Mediation is a process used by people to solve conflicts. This is an alternative way to resolve them and its aim is avoiding the civil proceeding. The plaintiffs act willingly and the target of this process is that a mediator, who is fair-minded, listens to both and draws every point which can be used to solve the initial conflict. The main task of the mediator is to find out the suitable answer to the conflict that was proposed. An agreement is made with the answer that was given, this agreement can have the power to enforce and for that it's needed to become in public deeds, this is needed if there is no civil proceeding, if there is a civil proceeding, the judge has to compose a judicial decree.
