La calificación registral y sus consecuencias en la fe pública

Abstract

[ES]La función calificadora oonstituye en nuestro ordenamiento jurídico una fase fundamental del preocdimiento registral, garantizándose mediante la misma que al Registro única y exclusivamente tendrán acceso títulos válidos y perfectos. Las consecuencias sustantivas derivadas de la publicidad registral, y que se erigen como uno de los pilares básicos sobre los que se asienta la seguridad del tráfico jurídico, imponen la observancia de una serie de exigencias para filtrar la titulación inscribible, denegando la inscripción de todo título formal que adolezca de defectos que impliquen su nulidad . Por ello la calificación registral, así como los efectos que ésta produce, estrechamente vinculados con la esencia del principio de publicidad en su doble vertiente de legitimación y fe pública, merecen un estudio particularizado, en el que se desarrollen los aspectos formales básicos del juicio calificador, además de cómo influye dicha actividad del Registrador en aquello relacionado con la publicidad del Registro.

[EN]The qualifying function represents in our legal system a fundamental phase in the registration procedure, guaranteeing the solely and exclusively valid and perfect titles will be admitted in the Registry. The substantive implications drawn from the registration publicity, which constitute one of the basic pillars on which the security in the legal traffic is settled, imposes the observance of a series of requirements in order to filter the registrable title, rejecting the registration of those titles, which present defects, which involves their nullity. Consequently, registry qualification, and its effects, closely linked to the essence of the principle of publicity in its double sense of: legitimacy and public faith, deserve a particularized study, to show on the one hand the basic formal aspects of the qualification criteria and on the other hand how the activity of the Registrar influences all matters related to the publicity which may arise from the Registry.
