Mediación familiar

Abstract

[ES]La mediación familiar es un procedimiento de gestión de conflictos en el que las partes enfrentadas acuerdan que una tercera persona cualificada, imparcial y neutral les ayude a alcanzar por sí mismas un acuerdo, que les permita resolver el conflicto que las enfrenta, sin necesidad de someterlo a una autoridad judicial.

En España actualmente no existe una regulación legal a nivel estatal de mediación familiar, sino que cada Comunidad Autónoma tiene su propia ley. En Andalucía tenemos la Ley 1/2009, de 27 de Febrero, reguladora de la Mediación Familiar en la Comunidad Autónoma de Andalucía

La mediación familiar se caracteriza por unos principios: voluntariedad, imparcialidad, neutralidad, confidencialidad y profesionalidad.

La finalidad del proceso de mediación familiar es lograr que las partes en conflicto alcancen acuerdos justos y duraderos, contribuyendo a evitar la apertura de procedimiento s judiciale s o contribuir a resolver los que ya estaban iniciados.

[EN]Family mediation is a procedure of conflict management in which the opposing sides agree with a third qualified, impartial and neutral person who helps them reach an agreement; enabling them to resolve their conflict without subjecting to a competent judicial authority.

In Spain, there is not a current statewide legal regulation of family mediation , but every autonomous community has its own law. Specifically, in Andalusia this matter is governed in the Law 1/2009, of February 27, regulating the Farnily Mediation in Andalusia.Family mediation is characterized by sorne principies: willingness, impartiality, neutrality , confidentiality and professionalism.

The purpose of the family mediation process is to make the disputing sides reach fair, stable, equitable and lasting agreements, contributing to avoid the initiation of legal proceedings or to help resolve those which have already been initiated.
