El contrato de aparcamiento de vehículos

Abstract

El denominado contrato de aparcamiento de veh ículos fue regu lado por primera vez en la ya conocida Ley 40/2002 de 14 de noviembre. Hasta entonces, era reput ado como u n contrato atípico y complejo, ya que venía del con tra to de depósito y del arrendamiento de cosa. Además, era necesario solucionar los posibles conflictos que puedan su rgi r entre las partes cont ratantes como son el titu lar del aparcamiento y el usuario y así, determi nar el grado de responsabilidad que puedan tener cada u no. Será también objeto de estudio las obligaciones de ambas partes como la obligación de vigilancia y custodia del vehículo y el pago del precio establecido.

The vehiclc parking contrae!was regulated for the first t ime in the Law 40/2002 of 141 November. Until then , it was considered an atypical and h complex contract, because it carne from deposit's contract and from the common leasehold. In addition, it needed to be resolved the possible conflicts that may have betwee n the parties such as t he owner of the parkin g and user and determine the degree of responsibility that cou l d have each one. It will also be aim of study the obligations of the parties such as the labor of surveillance and safekeeping and t hc payment of the price.
