Contratos Traslativos del Domirúo

Abstract

Este trabajo va enfocado al estudio de la transmisión del dominio en el ordenamiento jurídico español. Para ello hemos abordado los tres tipos de contratos existentes en nuestro ordenamiento juríd ico cuya finalidad esencial es la de transmitir el domirúo. Siendo necesario el estudio de los diversos aspectos relativos al contrato de compraventa, contrato de permuta y finalmente al contrato de donación, pero siempre resal tando el modo de adquisición de la propiedad que desemboca a la transmisión de la propiedad a un determinado patrimonio. Haciendo referencia que nuestro ordenamiento español sigue el sistema de transmisión de la propiedad de origen romano, es decir, que aunque nuestro código civil español claramente sigue la línea de inspiración del código francés, aquí se mantiene el sistema romano.

This work is focused on the study of the transmission of the domain in the juridical Spanish classification. For it we have approached three types of existing contracts in our juridical classification which essential purpose is it of transmitting the domain. Being necessary the study of the diverse aspects relative to the contract of sale, contract of barter and finally for the contract of donation, but always highlighting the way of acquisition of the property that ends to the transmission of the property to a certain heritage. Referring that our Spanish classification follows the system of transmission of the property of Roman origin , it is to say, that though our civil Spanish code clearly follows the line of inspiration of the French code, here the Roman system is kept.
