Derechos sociales y dignidad existencial. La renta básica.

Abstract

El presente trabajo se centra en el análisis de uno de los aspectos que ponen de manifiesto la tensión existente entre la efectividad de los derechos sociales de prestación y la crisis económica presupuestaria del Estado. El Estudio está dividido en dos partes estrechamente conectadas entre sí: la primera parte se centra en la problemática que acompaña los derechos sociales por su frágil justiciabilidad así como su normatividad en el marco jurídico de la Constitución Española. La segunda parte se ocupa de la renta básica como derecho social que, aunque no esté regulado de manera expresa en la Constitución Española, son los Estatutos de Autonomía de cada Comunidad Autónoma los que la dotan de regulación. Trato de darle sentido a este derecho social propio de la democracia, ya que con la situación de crisis que aún vivimos se ve vinculado a las condiciones presupuestarias.

This paper focuses on the analysis of one of the aspects that reveal the tension between the effectiveness of social rights provision and economic crisis of the state budget. The study is divided into two closely connected parts together: the first part focuses on the problems that accompany their social rights and their justiciability fragile regulations within the legal framework of the Spanish Constitution. The second part deals with the basic income as a social right which, although not expressly regulated in the Spanish Constitution, are the Statutes of Autonomy of each Autonomous Community that give it the regulation. 1try to make sense of this own social democracy law because with the crisis that we still live is linked to budgetary conditions.
