LA DENOMINA PENA DE "ALEJAMJAENTO" Y SU QUEBRANTAMIENTO

Abstract

La imposición de la "pena'' de alejamiento tiene distintas funciones: pena principal , aunque no esté tipificada legalmente como tal se establece su marco general en el artículo 48 CP; pena accesoria (artículo 57 CP), ya sea impuesta de forma potestativa o preceptiva; medida cautelar (artículos 544 bis y ter LECRIM); medida de seguridad (artículos 95 y ss CP) o regla de conducta (artículos 80 y ss <;:P) , cuando se haya producido la suspensión en la ejecución de la pena. Se expondrán las consecuencias del quebrantamiento de dicha orden, y se abordará una cuestión importante relativa a qué ocurre cuando la víctima muestra su consentimiento válido, de acercarse a su agresor, cualesquiera que sean los factores que influyan en ello. Se expondrá la posibilidad. a tenor de la legislación aplicable (artículo 48.4 CP), de instalar dispositivos telemáticos de control que hagan posible el cumplimiento de la pena de alejamiento impuesta.
