RESPONSABILIDAD CIVIL EXTRACONTRACTUAL POR LOS DAÑOS CAUSADOS EN UNA FINCA DERIVADOS DE UN INCENDIO

Abstract

[ES] El tema que se aborda es un caso real planteado en un despacho profesional, relativo a la posibilidad y ejercicio de una acción de responsabilidad civil extracontractual por los daños causados en una finca como consecuencia de un incendio. El demandante había intentado solucionar de una manera amistosa dicha cuestión jurídica, pero el demandado se se había negado en todo momento a asumir su responsabilidad por los daños ocasionados; por lo que el actor tuvo que entablar la correspondiente acción judicial para conseguir el resarcimiento. En el dictamen se analizan, teniendo a la vista la legislación, doctrina y jurisprudencia aplicable, si se dan los presupuestos sustantivos y procesales de dicha acción, en particular, los elementos relativos a la prueba, pronunciándose por su admisibilidad y la aplicación del art. 1902 del C.C a este supuesto controvertido, debiéndose indemnizar al actor los daños causados y probados de su finca.

[EN] The issue that is being addressed is a real case raised in a law farm relating to an action in tort for damages on a farm as a result of a fire. The plaintiff tried to solve this lawsuit in a friendly way but defendant has consistently refused to take responsibility for the damage caused, so the plaintiff had to file a claim to get compensation. Considering the applicable legislation, doctrine and case-law, the ruling analyzes if the substantive and procedural requirements for this civil action are given, and especially, the elements relating to legal evidence and the application of the article 1902 of the Civil Code to this litigation. So, the plaintiff must be fully indemnified for the damage caused and proven in his property.
