TRANSPARENCIA Y PANDEMIA: UNA COMPARATIVA ÍTALO-ESPAÑOLA

Abstract

Empezando por la definición general, las origines normativas y los conceptos conectados a la noción de transparencia administrativa, se desarrollan diferentes etapas históricas-legislativas en Europa y América hasta llegar a las divulgaciones en 2013 de las principales Leyes de transparencia vigentes en España e Italia desde las que toman referencia las medidas de los estados de emergencias por Covid-19 inaugurados a partir del primer trimestre del 2020. En perspectiva comparada ítalo-española, se analiza la salida de algunos problemas de opacidad en realidad ya configurados por antiguos desequilibrios en los dos países. Sobre temas de coordinación se examina el nacimiento de órganos de gestión no previstos, los caos regulatorios por la superposición y contradicción de Leyes desde cualquier nivel territorial, la existencia y posible aplicación de planes para la pandemia y la gestión del inevitable nacimiento de bulos acerca el tema de la importancia de la comunicación a la ciudadanía.

Starting with the general definition, the normative origins and the concepts connected to the notion of administrative transparency, different historical legislative stages are developed in Europe and America until the disclosures in 2013 of the main Transparency Laws in force in Spain and Italy, from that take reference the measures of the states of emergencies due to Covid-19 inaugurated from the first quarter of 2020. In a comparative Italian-Spanish perspective, the solution of some opacity problems is analyzed, already configured by old imbalances in the two countries. On coordination issues, the birth of unforeseen management bodies is examined, the regulatory chaos due to the overlap and contradiction of Laws from any territorial level, the existence and possible application of plans for the pandemic and the management of the inevitable birth of hoaxes about issue of the importance of communication to citizens.
