GARANTÍAS DEL CONTRIBUYENTE EN EL PROCEDIMIENTO DE INSPECCIÓN TRIBUTARIA

Abstract

El presente trabajo aborda las garantías que ostenta el obligado tributario durante un procedimiento de inspección. El contribuyente goza de numerosos derechos bien diferenciados en todas las fases que componen una inspección tributaria (inicio, desarrollo, terminación). El fin de este trabajo es incidir en todos estos derechos para por un lado plasmar donde se encuentran recogidos en la ley y por otro lado estudiar si verdaderamente en la práctica de una inspección se vulneran estos derechos, pues la Administración Pública ostenta unas facultades que le confieren cierta ventaja en sus relaciones con el obligado tributario.

The current Degree’s Final Project deals with the guarantees that the taxpayer holds during an inspection procedure. The contributor enjoys numerous well differentiated rights in all the phases that make up a tax inspection (start, development, completion). The purpose of this work is to impinge on all these rights to, on the one hand, show where they are included in the law and, on the other hand, to study whether these rights are truly violated while the inspection performance, since the Public Administration has powers which confer it a certain advantage in its fiscal relations with the taxpayer.
