Derecho al honor, a la intimidad personal y familiar y a la propia imagen. Especial referencia al menor en el marco de las redes sociales

Abstract

En el presente trabajo se tratará de abordar, los conceptos referidos al derecho al honor, a la intimidad personal y familiar e imagen. Así, examinaremos como afectan las redes sociales y su uso para interactuar y relacionarse respecto a los derechos protegidos por el artículo 18.1 de la Constitución Española. Debido a la preocupación generada por la protección de estos derechos se hará hincapié en las intromisiones en las cuales se pueden ver vulnerados los derechos de la personalidad y como estos problemas jurídicos pueden encontrar una solución en nuestro ordenamiento jurídico. Además, hablaremos de la transcendencia del derecho al olvido digital respecto de sus datos personales. De igual modo, haremos una especial referencial al consentimiento prestado por los menores cuando tengan suficiente madurez para ello e igualmente, consideraremos los posibles riesgos a los que se enfrentan los menores en la red.

In this work we will try to address the concepts related to the right to honor, personal and family privacy and image. Thus, we will examine how social networks affect and their use to interact and relate to the rights protected by article 18.1 of the Spanish Constitution. Due to the concern generated by the protection of these rights, emphasis will be placed on the interference in which the rights of the personality may be violated and how these legal problems can find a solution in our legal system. In addition, we will talk about the importance of the right to digital oblivion regarding your personal data. In the same way, we will make a special reference to the consent given by minors when they are sufficiently mature to do so and we will also consider the possible risks that minors face online.
