Ocupación del Dominio Público Local por las Infraestructuras de Telecomunicaciones

Abstract

El desarrollo de este trabajo se centrará en la rama administrativa del derecho, específicamente en el tema de la ocupación del dominio público por los operadores de las telecomunicaciones. Primeramente, pasaremos de lo general a lo particular partiendo de la constitución española y de la competencia que en la misma se le reconoce al estado en materia de telecomunicaciones. También expondremos los conflictos en la competencia ya mencionada que pueden surgir entre las distintas Administraciones Publicas lo que dará lugar a que entremos en lo que realmente nos interesa, que es la ocupación del dominio público local. Para lo cual, será necesario acudir a las ordenanzas locales que los distintos Ayuntamientos han emitido respecto a las telecomunicaciones. Por último, se expondrán los derechos que tienen los operadores para la ocupación del dominio público los cuales están estipulados en la Ley.

The development of this work will focus on the administrative branch of law, specifically on the issue of the occupation of the public domain by telecommunications operators. First, we will move from the general to the particular on the basis of the Spanish constitution and the competition that is recognized in it to the state in terms of telecommunications. We will also expose the conflicts in the aforementioned competition that may arise between the different Public Administrations which will result in us entering what we are really interested in, which is the occupation of the local public domain. For this, it will be necessary to go to the local ordinances that the various municipalities have issued regarding telecommunications. Finally, the rights of operators for the occupation of the public domain which are stipulated in the Act will be set out.
