LA PERSONA CON DISCAPACIDAD: SUPUESTOS PROBLEMÁTICOS EN RELACIÓN CON EL INTERNAMIENTO Y EL DERECHO DE DAÑOS

Abstract

El tema elegido para el Trabajo de Fin de Grado es el relativo a la persona con discapacidad psíquica y enfermedad mental, ahondando en las distintas problemáticas del ámbito civil, atendiendo en concreto a las relativas con el internamiento de la persona con discapacidad, así como algunos supuestos en relación con el derecho de daños y el derecho patrimonial. Mi decisión por inclinarme a investigar en estos temas en concreto se debe a que estamos ante un tema tan delicado y complicado como el de la mente humana, sobre todo cuando el derecho ha de intervenir, considerando que deben haber reformas y medidas jurídicas que aseguren la seguridad y una mayor protección de estas personas, pero como he dicho anteriormente es algo tan complejo que aún queda por saber más sobre este tema para que así pueda haber mayores garantías respecto a estas personas en el ámbito del derecho. The theme chosen for the TFG is the one related to the person with mental disabilities and mental illness, delving into the different problems of the civil sphere, specifically addressing those related to the placement of the person with disabilities, as well as some assumptions in relation to the law of damages and the patrimonial law. My decision to lean towards investigating these specific issues is due to the fact that we are dealing with such a delicate and complicated issue as that of the human mind, especially when the law has to intervene, considering that there must be reforms and legal measures that ensure the security and greater protection of these people, but as I have said previously it is something so complex that there is still more to know about this subject so that there can be greater guarantees regarding these people in the field of law.
