Evolución histórica del matrimonio en España

Abstract

El tema de estudio de este trabajo es la evolución histórica y jurídica que ha sufrido la institución del matrimonio en España durante más de ocho siglos. En primer lugar, abordaremos la regulación actual que presenta el sistema matrimonial español desde que se instauró la democracia, así como los distintos cambios y reformas que lo han ido remodelando. Posteriormente, en los capítulos siguientes del trabajo haremos un recorrido a lo largo del tiempo para ver cómo, mientras una parte del sistema matrimonial se ha mantenido casi inmutable en el tiempo, otra ha ido evolucionando y cambiando influenciada por los factores y las situaciones históricas que se fueron aconteciendo en el tiempo. Otro de los aspectos que abordaremos dentro de estos capítulos es como el matrimonio canónico, así como la Iglesia en general, han ido cediendo y abriendo camino al matrimonio civil y a la aconfesionalidad de este y del Estado en su conjunto. A modo de conclusión trataremos sobre la época preconstitucional que fue la que realmente sentó las bases que dieron el cambio radical a la institución matrimonial tal y como se conocía hasta el momento. Y además permitió la instauración de una igualdad real, así como libertad religiosa y personal tanto en el matrimonio como fuera de él. The theme to study of this research work is the historical and legal evolution that the institution of marriage has undergone in Spain for more than eight centuries. Firstly, we will address the current regulation presented by the Spanish marriage system since democracy was established, as well as the various changes and reforms that have been reshaping it. Subsequently, in the following episodes of the work, we will go through time to see how, while one part of the marriage system has remained almost unchanged over time, another has been evolving and changing influenced by the factors and historical situations that they were happening in that time. Another aspect that we will know within these episodes is how canonical marriage, as well as the Church in general, have been giving way and opening the way to civil marriage and it’s non-confessional state and that of the State as a whole. By way of conclusion, we will talk about the pre-constitutional era that was the one that really established the bases that gave the radical change to the matrimonial institution as it was known until then. And it also allowed the establishment of real equality, as well as religious and personal freedom, both inside and outside of marriage.
