Garantía en la venta de bienes de consumo

Abstract

[ES]La materia objeto de este trabajo es la Garantía de bienes y servicios postventa, en la cual hay que destacar tanto la Directiva 1999/44/CE como la Ley 23/2003, que indicaban las medidas para garantizar la protección de los consumidores haciendo referencia al principio de conformidad de los bienes con el contrato de venta; y también destacar que esta Ley está derogada por el Real Decreto Legislativo 1/2007, en el cual se aprueba el Texto Refundido de la Ley General de la Defensa de los Consumidores y Usuarios. Este texto refleja que los consumidores deben ser conformes con el contrato que el vendedor le entrega y este debe responder a cualquier falta de conformidad del consumidor en el momento de entrega. Existen una serie de requi sitos para la conformidad del producto con lo estipulado en el contrato y en el caso de una falta de conformidad.

[EN]The subject matter of the present work is the Guarantee for consumer goods and after-sales services, where Law 23/2003 must be pointed out, which indicates the measures to guarantee the consumer protection by making reference to the principle of conformity of the goods with the sales contract. Also, it should be pointed out that this Law is abrogated by the Royal Legislative Decree 1/2007, where the Consolidated General Law on the Protection of the Rights of the Consumers and Users is approved. This text reflects that consumers must be in agreement on the contract delivered by the seller, who must be liable to the consumer for any lack of conformity which exists at the time the goods are delivered.
