DERECHO A LA VIDA DESDE UNA PERSPECTIVA CONSTITUCIONAL

Abstract

[ES] Este trabajo fin de grado, sintetiza la problemática jurídica entorno al aborto; enumera una concepción histórica sobre mujer y aborto, así como la problemática jurídica nacional e internacional, todo ello en un concepto de jurisprudencia práctica, que nos permitirá dilucidar las posibles soluciones que están dando los juzgados nacionales, así como los tribunales internacionales. Las constituciones modernas empezaron a incluir referentes preceptos sobre libertad e igualdad que permitió a la mujer tener especiales consideraciones en lo referente al aborto; no fue hasta la famosa propuesta de Gallardón donde empezaron a incluir el aborto por plazos médicos, así como las condiciones para realizar esta práctica, que declararían mediante un recurso de inconstitucionalidad la ratificación y aplicación en todo el territorio nacional, así como la posterior reforma e inclusión en el Código Penal.

[EN] This final degree work synthesize problematic about abortion, list historical conception about womens and abortion, moreover legal problematic national and internacional, all of this in a practical jurisprudence conception, will allow us to elucidate the possible solutions that national courts are giving, as well as international tribunals, From the ancient history, the problematic of the woman revolves expressly in the lack of consent at the time of realizing not only the abortive practice but any legal business. On the other hand, modern constitutions began to include references to precepts about freedom and equality that allowed women to have special considerations regarding abortion.
