EL ABORTO DESDE UNA PERSPECTIVA CONSTITUCIONAL

Abstract

[ES] Analizaremos una cuestión que hoy en día sigue suscitando mucho interés como es el aborto. Para ello haremos un repaso por la historia legislativa sucedida en nuestro país en cuanto a esta materia, para a continuación centrarnos en el sistema actual, realizando un análisis detenido de todos sus pormenores, dando gran importancia al conflicto de intereses que se provoca entre la protección del nasciturus, y la protección de los derechos de la mujer gestante. Seguidamente, analizaremos la fallida propuesta de reforma en esta materia, al igual, que lo referente a la objeción de conciencia. Por último, nos centraremos en la jurisprudencia más relevante y la legislación en países europeos como Italia y Alemania.

[EN] We'll look at a question that today remain keen as it is abortion. To do this we will do a review by the legislative history happened in our country regarding this matter, then focus on the current system, carrying out an examination of all its details, attaching great importance to the conflict of interest that is raised between the protection of the unborn child, and the protection of the rights of the pregnant woman. Next, we'll look at the failed proposal for reform in this area, as well, as regards conscientious objection. Finally, we will focus on the most relevant jurisprudence and legislation in European countries like Italy and Germany.
