LA LEGÍTIMA VIUDAL

Abstract

[ES] El objeto de este trabajo es el estudio de la legítima del cónyuge viudo. Esta legítima ha sufrido importantes modificaciones hasta su actual regulación en el Código civil. Su estudio se debe a las especialidades que contiene respecto a las demás legítimas y su importancia radica en la ventaja o desventaja que supone para el viudo la aplicación de este sistema respecto a sus derechos sucesorios como cónyuge supérstite. Consiste en un derecho del cónyuge viudo, derecho que encuentra su regulación en la Sección VII, Capítulo II, Título III del Libro Tercero del Código civil. El reto normativo se concreta en analizar su integración con el resto de las legítimas de hijos y descendientes y padres y ascendientes. Así como una valoración crítica sobre su adjudicación y formas de pago, teniendo en cuenta que el cónyuge es un legitimario más de los señalados por el artículo 807 del Código civil.

[EN] The object of this project is the study of the legitimacy widowed spouse. This legitimacy has undergone important modifications until its current regulation in the Civil Code. Its study is due to specialties that contains with respect to the other legitimacies and its importance lies in the advantage or disadvantage that for the widowed supposes the application of this system with respect to his inheritance rights as a surviving spouse. It consists of a right of the widowed spouse, a right that finds its regulation in Section VII, Chapter II, Title III of the Third book of the Civil Code. The normative challenge is concrete in analyzing its integration with the rest of the legitimate ones of children and descendants and parents and ascendants. As well as a critical assessment about its award and forms of payment, taking into account that the spouse is a legitimary more than those indicated by article 807 of the Civil Code.
