El testamento ológrafo en el Código Civil español

Abstract

[ES] El testamento es una de las instituciones clave del derecho sucesorio. Se trata de la herramienta sucesoria predilecta en el derecho civil, donde la voluntad del testador es la que determina el destino de los bienes, y no un imperativo legal. El Código Civil distingue diversas clases de testamentos, siendo una de ellas la ológrafa. El testamento ológrafo es el único medio por el cual, una persona, puede ordenar su última voluntad por sí sola, sin necesitar la intervención de nadie. A esta modalidad testamentaria le son exigidas para su validez, formalidades tanto en el momento de su otorgamiento, como a la muerte de su autor, de forma previa a que la voluntad contenida en él cause efectos, con el fin de comprobar su autenticidad.

[EN] The testament is the key institution of Inheritance law. It is the favourite tool in the Civil Law, where the will of the testator determines the fate of the assets, not a legal imperative. There are several types of testaments in the Civil Code, the main one is the Holographic. The Holographic testament is the only mean by which a person can create his/her last will without any intercession. To be valid, this type of testament demands some formalities both in the moment of granting and at the death of the testator, in order to prove its authenticity before the will expressed in the testament may cause any effects.
