Consecuencias económicas y familiares del divorcio.

Abstract

[ES] Para este trabajo se ha puesto de manifiesto aquellas instituciones jurídicas derivadas de la disolución matrimonial, en concreto del divorcio. Instituciones como la patria potestad, la guarda y custodia, los alimentos, la vivienda familiar, la pensión compensatoria e incluso la propia figura del divorcio se han visto modificadas en los últimos años por la Ley 13/2005, de 1 de julio, por la que se modifica el Código Civil en materia de derecho a contraer matrimonio, que permitió en España y por primera vez el matrimonio entre personas del mismo sexo, también por la Ley 15/2005, de 8 de julio, por la que se modifica el Código Civil y la Ley de Enjuiciamiento Civil en materia de separación y divorcio, con la que se deja atrás el sistema causal del divorcio, apareciendo un nuevo sistema donde prima la autonomía de la voluntad, y por último complementando la numerosa jurisprudencia tanto del Tribunal Constitucional, Tribunal Supremo y de las Audiencias Provinciales que suponen un avance hacia una sociedad más libre en la cual la autonomía de la voluntad tiene un papel preponderante.

[EN] For this work has been revealed those legal institutions derived from the dissolution of marriage, specifically divorce. Institutions such as parental authority, custody, food, family housing, compensatory pension and even the very figure of divorce have been modified in recent years by Law 13/2005, of July 1, by the that the Civil Code is modified in terms of the right to marry, which allowed in Spain and for the first time marriage between people of the same sex, also by Law 15/2005, of July 8, by which the Code is modified Civil and the Civil procedure Law on separation and divorce, which leaves behind the causal system of divorce, appearing a new system where the autonomy of the will prevails, and finally complementing the numerous jurisprudence of both the Constitutional Court, Supreme Court and the Provincial Courts that suppose an advance towards a freer society in which the autonomy of the will has a preponderant role.
