EVOLUCIÓN DE LA ADOPCIÓN EN LA LEGISLACIÓN ESPAÑOLA: LA ADOPCIÓN ABIERTA

Abstract

[ES] La adopción tiene como finalidad integrar a un menor en la esfera familiar para crear una relación de parentesco. Por este motivo, el interés y la protección del menor juegan un papel predominante en el procedimiento de adopción. Asimismo, la legislación española incluye a parte de la adopción, el acogimiento, donde el menor convive temporalmente con la familia acogedora, la adopción internacional y la adopción abierta. Esta última, regulada en España desde la reforma producida en el año 2015, tiene por finalidad mantener el vínculo preexistente entre el menor y la familia de origen.

[EN] The purpose of adoption is to integrate a child into the family sphere to create a family relationship. For this reason, the child’s interest and protection play a predominant role in the adoption procedure. Likewise, Spanish legislation includes, fostering, where the child temporarily coexists with the Foster family, international adoption and open adoption. The last reform in Spain in 2015, aims to maintain the pre-existing link between the child and the origin family.
